Fatal Recall is a prediction tool. It simulates a day-after recall test using a panel of AI personas built on established memory science principles. It produces a probabilistic estimate, not a measurement of human behaviour.
It is not a substitute for a human recall study, a brand tracker, or any form of market research conducted with real respondents. Scores are directional. Do not present Fatal Recall output to a client or third party as measured human recall. You are responsible for how you describe and use the output.
You retain all rights in the creatives you upload. By uploading, you grant us a limited licence to process that content solely to generate your report and to store it for the retention period set out in our Privacy Policy. We claim no other rights.
We do not publish or share your creative, and we do not use it in our own marketing, without your separate written permission.
Our AI processing provider's commercial terms state that API submissions are not used to train their models. That is their commitment, not a guarantee we can give on their behalf.
We do build anonymised category benchmarks from test results, using derived scores and metadata only. These never include your creative, your brand name, or any identifying detail. If you prefer your account excluded from benchmarks, email us and we will exclude it.
You confirm that you have the right to upload each creative and to have it processed. Do not upload content that infringes third-party rights, contains personal data of individuals beyond what appears in the creative itself, or is unlawful.
New accounts receive one free test. Paid tiers are released in batches. Credits are tied to your account, are non-transferable, and do not expire while your account is active. The Systemic tier is subject to a fair use limit of 100 tests per calendar month.
Because each test consumes AI processing at the moment you run it, completed tests are non-refundable. If a test fails for technical reasons on our side, the credit is returned automatically. If it is not, contact us and we will restore it.
The service is provided as is. We do not guarantee uninterrupted availability. We may change, suspend or discontinue features. Where a change materially reduces what you have paid for, we will offer a pro-rata credit.
To the maximum extent permitted by law, our total liability to you is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for business decisions made on the basis of Fatal Recall output.
These terms are governed by the laws of the Slovak Republic. Disputes fall to the competent courts of the Slovak Republic.
